Texas Real Estate Commission license update

January 27, 2012
Please note that TREC sent out the following message today: If your license expires Jan. 31, 2012, and you haven't yet renewed it, you'll need to e-mail the Texas Real Estate Commission before you can complete the online renewal process. The "token" that TREC e-mailed you 90 days before your license-expiration date no longer works, and you'll need a new one to renew your license. Send an e-mail to information@trec.texas.gov with the subject "Token number reset." The commission says someone will send you a new, working token within 24 hours.

QUESTIONS AND ANSWERS ON THE SENTRILOCK CONVERSION

Why are we switching to new lockboxes? Our current system has been in place since 2005 but many of the existing lockboxes require extensive maintenance from GEPAR staff. In addition, our contract with SentriLock has expired and there is no warranty or support services without a new contract being executed. The lockbox task force felt the new Sentrilock product had greater durability and would serve our membership for a longer period of time than the current lockboxes.

TREC Mandatory Revised Forms

On Feb. 14, the Texas Real Estate Commission revised the contracts that had been adopted and posted for voluntary use on Nov. 15, 2010, with a mandatory use date of March 1. The change removes the new Paragraph 15B, which provided a time period for asserting a claim for specific performance, and returns Paragraph 15 to the way it existed prior to the adoption of the new contracts.

Fannie Mae Changes Rules for Borrowers with a Prior Short Sale or Deed-in-Lieu of Foreclosure

On April 14, 2010, Fannie Mae released Announcement SEL-2010-05 revising its rules regarding the eligibility of a borrower to obtain a new mortgage after a pre-foreclosure event (a short sale (also known as a pre-foreclosure sale) or a deed-in-lieu of foreclosure). For a consumer with a prior short sale or a deed-in-lieu of foreclosure without an extenuating circumstance, the new waiting periods are 2 years with a 80% maximum LTV, 4 years with a 90% maximum LTV, and 7 years otherwise.

Have you filed your mixed-use vehicle exemption?

The passage of Proposition 6 in the November 2007 constitutional election ensured that your personal automobile was exempt from ad valorem taxation, as long as you filed the annual exemption form with your appraisal district. The rules of the exemption were tweaked In the 2009 legislative session to allow an exemption form to be filed once and remain valid until that vehicle changes ownership. Thus, this is the first tax year that you can file the one-time exemption, and the deadline to file is April 1.
